Successful Defense Of Client In A $60 Million Intellectual Property Case

Our firm was retained to defend a client against possible intellectual property infringement case. The plaintiffs sued several competitors and lodged allegations against different New York State agencies and a New York State official claiming that these parties permanently damaged their companies. The litigation focused on the maintenance of a safety partition device that had been created by the plaintiffs and who had the right to maintain these devices, which had been installed at various locations throughout New York State. The Complaint asserted claims of alleged patent infringement, copyright infringement, trademark infringement and unfair competition, civil conspiracy, and tortious interference with prospective clients. The only remaining claims against our client was tortious interference and trademark infringement and unfair competition.

Early on in the litigation, we were successful in dismissing the copyright infringement, patent infringement, and civil conspiracy causes of action against our client because the plaintiffs failed to plead a viable cause of action against the client.

The parties engaged in extensive paper discovery before depositions were commenced. After all discovery was completed, we moved for summary judgment to dismiss the remaining claims against our clients. We argued how there was no evidence that our client infringed on any trademark, our client did not engage in any wrongful acts and did not tortuously interfere with any prospective clients. The Court agreed with our arguments and all claims against the client were dismissed.
